Terms of Service
These Terms of Service (“Terms”) are an agreement between you and Don Hillsberry, doing business as Bouncing Pebbles (“Bouncing Pebbles”, “we”, “us”) and govern your use of Coffer. By using Coffer, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Coffer.
1. The service
Coffer is a private, read-only service. It brings together balances, transactions and investment holdings from the financial institutions you choose to connect, and makes that information available to you and to tools you authorize. Coffer cannot move money, make payments, place trades or change anything at your institutions.
2. Eligibility and invitations
Coffer is available by invitation only. To use it, you must be at least 18 years old, be located in the United States, and be authorized to access each account you connect. You may use Coffer only for your own personal, non-commercial purposes. Invitations are personal and may not be shared.
3. Connecting financial institutions
You connect an institution by approving access on that institution’s own website, through Akoya, a data access network. By doing so, you authorize us to retrieve, store and display the information you choose to share, on your behalf, until you revoke that authorization. Your institution’s and Akoya’s terms continue to apply to your accounts and to the connection. You can revoke access at any time at your institution or by contacting us. We are not responsible for the availability, accuracy or timeliness of information provided by institutions or Akoya.
4. Information, not advice
Coffer displays information supplied by your institutions. That information may be delayed, incomplete or occasionally wrong, and your institution’s own records are authoritative. Coffer does not provide financial, investment, tax, legal or accounting advice, and nothing in Coffer is a recommendation. Confirm important information with your institution before relying on it.
5. Tools you connect
You may authorize software, such as an AI assistant, to access your Coffer information. You choose which tools to authorize and are responsible for that choice. Those tools are provided by others under their own terms. We do not control them, and their responses may be inaccurate. You can withdraw a tool’s authorization at any time.
6. Your responsibilities
You agree to:
- keep your sign-in account secure, and tell us promptly at security@bouncingpebbles.com if you suspect unauthorized access;
- give accurate information when you are invited and when you contact us; and
- use Coffer lawfully and only as these Terms allow.
You agree not to:
- access Coffer, or any account through it, without authorization;
- probe, scan or test Coffer for vulnerabilities, except as allowed by the vulnerability disclosure guidelines on our Security page;
- interfere with or disrupt Coffer, or try to get around its security;
- copy, modify, reverse engineer or resell Coffer; or
- use Coffer to violate anyone’s rights or any law.
7. Fees
Coffer is currently provided to invited users without charge. If we introduce fees, we will tell you in advance, and you will not be charged unless you agree to them.
8. Availability and changes to the service
We work to keep Coffer available and accurate, but it is provided on an “as available” basis. We may change, suspend or discontinue features, or Coffer as a whole. If we discontinue Coffer, we will give you reasonable notice where we can and delete your information as the Privacy Policy describes.
9. Ownership
You own your financial information. You give us permission to retrieve, store, process and display it only to provide Coffer to you, as described in the Privacy Policy. We and our licensors own Coffer, including its software, design and content. These Terms give you no rights in Coffer other than the right to use it as described here.
10. Suspension and ending your use
You may stop using Coffer at any time and ask us to delete your information. We may suspend or end your access if you breach these Terms, if that is needed to protect Coffer, other users or institutions, or if the law requires it. When your access ends, we disconnect your institutions and delete your information as the Privacy Policy describes. Sections 4, 9, 11, 12, 13, 15 and 16 continue to apply after your use ends.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, COFFER IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT COFFER WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY INFORMATION WILL BE COMPLETE, CURRENT OR ACCURATE.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO COFFER OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO COFFER OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR COFFER IN THE 12 MONTHS BEFORE THE CLAIM AND ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
13. Indemnity
To the extent the law allows, you agree to indemnify us against claims, losses and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of Coffer.
14. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date, and for material changes we will email invited users at least 30 days before the changes take effect. If you keep using Coffer after changes take effect, you accept them.
15. Governing law and disputes
These Terms are governed by applicable federal law of the United States and the laws of the state in which the operator of Coffer is based, without regard to conflict-of-law rules.
If a dispute arises, please contact us first at support@bouncingpebbles.com. We will try to resolve it informally within 30 days before either of us starts a formal proceeding.
16. General
These Terms and the Privacy Policy are the entire agreement between you and us about Coffer. If a court finds any provision unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer these Terms. We may transfer them as part of a reorganization or transfer of Coffer, including to a company formed to operate it, and we will tell you if we do.
